Rainwater Private Tutoring is a one-person practice. I work directly with a small number of students and their families, and I treat the information you share with me the way I would want mine treated. This policy explains exactly what I collect, why, who else touches it, and how to make me delete it.
1. Who we are and what this covers
Rainwater Private Tutoring (“we,” “I,” or “the Tutor”) is a sole proprietorship operated by Michael Rainwater, based in Athens, Georgia. I am the data controller for everything described here.
This policy applies to:
- rainwatertutoring.com — this marketing website and its contact and referral forms.
- assessment.rainwatertutoring.com — the diagnostic and practice tools.
- billing.rainwatertutoring.com — invoicing and payment.
It does not cover third-party websites you reach by following a link from any of these.
2. What we collect
Information you give us directly. When you submit the contact form or the referral form, we collect the name, email address, and phone number you enter, any free-text message or notes you write, and whether the student is under 18. If you refer a family, we collect the contact details you provide about them.
Assessment and diagnostic information. Some diagnostics ask for an email address before showing results. Where you take a diagnostic, we store your answers, scores, timing data, and the resulting analysis so the results can be reviewed and discussed with you.
Billing information. Invoices, amounts, payment status, and receipts. We never see or store full card numbers or CVV codes — card data is entered directly with our payment processor and is held by them, not by us.
Information collected automatically. Standard server logs (IP address, browser and device type, referring page, timestamps) and analytics identifiers set by cookies, as described in Section 5.
What we deliberately do not collect. We do not ask for Social Security numbers, government identification numbers, financial account numbers, or health information, and you should never send them to us.
3. How we use it
- To answer your inquiry and arrange a consultation.
- To schedule, deliver, and prepare for tutoring sessions.
- To produce diagnostic results, progress reports, and session notes.
- To invoice you and collect payment.
- To send you messages about your engagement, and — only if you have asked for them — occasional updates about availability or services.
- To keep the sites working, secure, and reasonably free of spam and abuse.
- To meet legal, tax, and accounting obligations.
We do not use your information to build advertising profiles, and we do not run behavioral advertising on these sites.
4. Who else touches your information
We use a small number of service providers. They process information on our behalf, under their own security and privacy commitments, and only for the purposes above:
- Vercel — website hosting and server logs, and Vercel Analytics for aggregate traffic measurement.
- Resend — delivery of email sent from our forms and to clients.
- Google Analytics (property G-WC32BGSY6S) — website usage measurement. See Section 5.
- Supabase — storage for assessment and diagnostic data.
- Helcim (or our then-current payment processor) — card processing and receipts.
Beyond these, we disclose personal information only: to the parent or guardian of record for a student under 18; where you have asked us to (for example, sending results to a school counselor); to a collections agency or court for a genuinely past-due balance; or where the law requires it. We do not sell personal information, and we do not share it for cross-context behavioral advertising.
5. Cookies, analytics, and Do Not Track
These sites use cookies and similar identifiers for two purposes: keeping the site functioning (for example, remembering that you have unlocked a private page during your browser session), and measuring usage.
We use Google Analytics 4. Google Analytics sets cookies that assign your browser a random identifier and record which pages you view, roughly where in the world you are, and what kind of device and browser you use. This data tells us which pages are useful; it is not used to identify you personally, and we have not enabled Google’s advertising or remarketing features. Google processes this data as described in its own privacy documentation.
You can opt out of Google Analytics entirely by installing Google’s browser opt-out add-on, or by blocking or clearing cookies in your browser settings. Blocking analytics cookies does not affect your ability to use the sites.
Do Not Track. Some browsers can send a “Do Not Track” signal. There is still no common industry standard for interpreting it, and these sites do not currently respond to Do Not Track signals. We are telling you this plainly because California law requires the disclosure. We also do not permit third parties to collect personally identifiable information about your activity across other websites through our sites.
6. Children and parents
This is the part that matters most in a tutoring practice, so it is worth reading closely.
Students under 13. The Children’s Online Privacy Protection Act (COPPA) governs the online collection of personal information from children under 13. Our website is directed at parents and guardians, not at children. We ask that inquiries concerning a student under 13 be submitted by the parent or guardian, not by the child, and we do not knowingly collect personal information online directly from a child under 13 without verifiable parental consent.
If we learn that a child under 13 has submitted personal information to us without a parent’s involvement, we will delete it promptly. A parent or guardian may at any time ask us to review what information we hold about their child, ask us to delete it, or refuse to allow us to collect any more of it — without that refusal affecting the child’s ability to be tutored. Students under 18. Our contact form asks whether the student is under 18. When the answer is yes, we bring a parent or guardian into the conversation as a matter of standing practice. Scheduling and billing communications go to the parent or guardian; instructional communication may go directly to the student. Session notes, diagnostic results, and progress reports for a minor are shared with the parent or guardian of record.
What we do not do. We do not require a child to disclose more information than is reasonably necessary to participate in tutoring, we do not use children’s information for advertising or profiling, and we do not disclose it publicly.
7. How long we keep it
We keep information only as long as there is a reason to:
- Inquiries that do not become engagements — up to two years, then deleted.
- Active client records (session notes, diagnostics, progress reports) — for the duration of the engagement and up to three years afterward, so that a returning family’s history is intact.
- Billing and tax records — as long as tax and accounting law requires, generally seven years.
- Server logs and analytics — per the retention settings of the providers named in Section 4, typically 14 months or less for analytics.
You can ask us to delete sooner. See Section 8.
8. Your choices, and how to exercise them
Whatever state you live in, you may ask us to:
- Tell you what we hold about you or your child, and where it came from.
- Give you a copy of it.
- Correct anything inaccurate.
- Delete it, subject to records we are legally required to retain (billing and tax records, chiefly).
- Stop emailing you — every marketing email includes an unsubscribe link, and you can also just tell us. Unsubscribing from marketing does not stop essential messages about an active engagement, such as an invoice or a schedule change.
How to ask. Email info@rainwatertutoring.com or call (706) 389-0528. We will confirm we are speaking with the right person — for a minor, with the parent or guardian of record — and respond within 30 days. There is no charge, and we will not treat you differently for asking.
Reviewing and changing information you have submitted. If you have sent us information through a form and want to see or change it, use the same contact details above; we will show you what we have and amend it on request.
9. Security
We use reasonable administrative and technical safeguards appropriate to a practice of this size: encrypted connections (HTTPS) across all three sites, access limited to Michael Rainwater alone, reputable service providers for hosting and payments, and private student reports that are encrypted and released only to someone holding the password we shared with the family directly.
No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. If a breach of unencrypted personal information occurs, we will notify affected individuals in the most expedient time possible and without unreasonable delay, consistent with Georgia’s data breach notification law (O.C.G.A. §§ 10-1-910 to 10-1-912) and any other law that applies.
10. Visitors outside the United States
We operate in Georgia, USA, and our service providers store data in the United States. If you contact us from outside the United States, your information will be transferred to and processed in the US, where privacy laws may differ from those in your country. By contacting us, you understand that this transfer takes place. If you are in a jurisdiction that grants you additional rights over your personal data, write to us and we will honor requests we can reasonably verify.
11. Changes to this policy
If we change this policy, we will post the revised version at this address and update the “Last Revised” date at the top of the page. Material changes will be flagged conspicuously on this page, and where we hold your email address in connection with an active engagement, we will tell you directly. Continued use of the sites after the revised date means you accept the updated policy.
